Danish man given deferred sentence for posting explicit film clips on the social platform Reddit

A Danish citizen has been convicted of uploading sexually explicit scenes from copyrighted films and television shows on the social media site Reddit.

According to a police report reviewed by BBC News, the anonymous man posted 347 video excerpts of nude content in a Reddit group he moderated, which were then watched 4.2 million times.

The country's authorities confirm he has been given a seven-month deferred jail term for copyright infringement.

Experts say the defendant was prosecuted under a seldom-invoked clause in Danish copyright law, with the court finding that by removing the scenes out of their original context, the man had harmed the artists' "moral rights".

He has additionally been convicted of sharing more than 25 TB of protected digital content.

From March 2022 to May 2023, the man using the alias "the pseudonym KlammereFyr" on Reddit posted sexually explicit scenes featuring over 100 actresses.

He shared them in the subreddit he was a administrator of.

Per the Denmark's anti-piracy organization the Rights Alliance, his online community had more than 6,000 subscribers and users were encouraged to ask for clips of particular actors.

In 2023, advocates reported the case to the police on behalf of the impacted artists, directors and producers, which resulted in the subreddit being closed down.

One actress, among the performers whose nude scenes were circulated in the group, told Danish broadcasters at the period she believed there was a difference between being seen unclothed in a movie and appearing on Reddit.

The performer stated the posts amounted to "abuse".

'A significant signal'

The man was detained in September 2024 and pleaded culpable to the allegations recently.

In a comment following the ruling, TRA head the organization's leader said the decision sent an "significant" signal "indicating infringements of creators' entitlements have repercussions".

The verdict is considered unique in the country for its use of the "ethical protections" section of the Danish Copyright Act, which states an artist's creation cannot be used in a manner which infringes upon their standing.

Intellectual property expert Dr Alina Trapova told the media the legal matter was "unusual" for its emphasis on the damage to the integrity of an artist, rather than to them economically.

The extent to which the case could influence nations abroad is unclear.

But she said there may be "more and more of these actions" in the future with the growth of artificial intelligence, where "the sanctity of one's creative output might be tempered with with greater ease".
